I wanted to share this with the forum just to warn you that this happens. Be careful.
I took my Fazer in to **** (Yahama Dealer) in *** (West London) and asked for loaner / courtesy bike whilst mine was being fixed. All ok until a ANPR equipped copper pulled me as it had been flagged up as not being insured. I explained the situation to him, most understanding, and he got his insurance bureau to phone CIS (their alleged insurers) to clarify the situation. It turns out that they have 4 bikes down on this policy for use by staff and customers for business related matters, not one of them was the one I was on.
Instant 6 points, 200 quid fine, 100% insurance loading for any premium for the next 5 years (not just car / bike, but house, travel, hire cars etc.)
Bike gets seized at the side of the road and I have to walk to work / cab back to pick up my Fazer, still not fixed, but rideable.
Long and short of it is that I am liable as I am riding the bike, even though I have a document from the shop that "claims" I am insured. An admin cock up on their part, does not exonerate me.
Suggestion for future, get clause on your insurance to ride any bike if being loaned to you. I thought I had this but it turns out that it is not the norm on bike fully comp insurance, unlike most car policies.
I have requested to be dealt with by a court, and hope to find an understanding magistrate, and not just take it on the chin, but now run the risk of increased fines or court costs. The company that let me ride a bike uninsured, however, gets away with it, even though it is an offence.
Time for a chat with my Solicitor.....!!
Forwarned people..... Hope it saves you one day....
Alex
PS Stay upright.
Edited by OMF to take out exact dealers details, as there will be a court case
